PATRICIA M. AYD

As a founding member of Consilia Conflict Resolution, LLC, I am committed to using my 35 years of litigation experience to assist parties in conflict to resolve their disputes more effectively, efficiently and economically through the use of alternative dispute resolution processes. From my extensive experience representing corporations and individuals in litigation ranging from class actions and complex insurance, business, real estate and products liability cases to simple tort and contract disputes, I understand the toll that litigation takes not only on an individual litigant, but also on the employees of companies sued as well as the corporate entity. I appreciate the costs, risks and frustration of litigation at the corporate and personal level and understand the value to all parties of resolution through a settlement. I am dedicated to encouraging parties to utilize ADR to find early and perhaps creative resolutions of their conflicts before they have become invested in their litigation positions. I believe that the best resolutions are those that come from the parties, not those imposed by the courts.

While substantive knowledge of the subject matter of the dispute is not a necessary component to serving as a mediator or arbitrator, sometimes parties are more comfortable knowing that the ADR provider has such knowledge. I have extensive trial and ADR experience in the following:
In addition to providing services as a mediator or arbitrator, I am available to serve as a discovery master in the above types of cases. Often the parties can reduce litigation costs and more quickly move the case forward to an agreed resolution, or if necessary arbitration or trial, through the use of a master. Use of a master puts the parties in control of the timing, thus avoiding the delays occasioned by the judicial time constraints which can result in long and costly delays in resolution of discovery matters.

- commercial litigation including real estate, partnership, securities and fiduciary duty claims;
- litigation of PIP/ Medical Payments, UM, and UIM claims;
- coverage advice and declaratory judgment actions concerning insurance coverage; and appeals.
